The current legal framework for online content dissemination has proven insufficient to effectively combat illegal content. The Commissions' proposal for an EU ‘Digital Services Act’ aims to update the horizontal framework for intermediaries and create a safe online environment. However, as far as content mediation is concerned, European fundamental rights and values require that the specificities of media law must be taken into account.This study, conducted by the Institute of European Media Law (EMR) on behalf of the Media Authority of NRW, describes the current legal framework and the DSA proposal, and provides a comprehensive assessment from the perspective of media law, complemented by alternative proposals for further improvement.

Die europäische AVMD-Richtlinie, die auch die deutsche Medienregulierung determiniert, befindet sich seit 2016 in einem Reformprozess. Insbesondere der materielle Anwendungsbereich der Richtlinie wird dem Anspruch einer rechtssicheren Unterscheidung zwischen regulierungsbedürftigen und nicht-regulierungsbedürftigen Diensten nicht gerecht. Auch mit der Neugestaltung der Richtlinie werden die Herausforderungen der Medienkonvergenz nicht angemessen bewältigt. Ausgehend von diesen Defiziten konzipiert die Autorin eine alternative Ausgestaltung des materiellen Anwendungsbereiches, die auf rechtsvergleichende Erkenntnisse der Medienregulierung in Großbritannien, Australien, Neuseeland und Deutschland zurückgreift und maßgeblich an die Meinungsbildungsrelevanz der Angebote anknüpft.

This volume in the Swedish Studies in European Law series, produced by the Swedish Network for European Legal Studies, heralds the new harmonised regime of private enforcement of EU competition law. In 2013, the Commission issued a Communication and Practical Guide to the quantification of harm in antitrust litigation and a Recommendation on collective redress. In 2014, the long-awaited Directive on actions for damages for infringements of EU competition law was finally adopted. In Transboundary Water Cooperation in Europe , Götz Reichert analyzes the multidimensional regime for the protection and management of European transboundary freshwater resources that is composed of international water law, the water law of the European Union, and domestic water legislation. Accordingly, qualitative and quantitative aspects regarding surface waters and groundwater are to be managed in an integrated manner to achieve “good water status” of rivers, lakes and aquifers. To this end, “international river basin management plans” provided for by the EU Water Framework Directive are developed by international river commissions for Europe’s major transboundary river basins. Götz Reichert analyzes the various dimensions of the regime including their legal interlinkages and considers the question of whether it is successful in achieving its ambitious goals.
